Pensioner in dock almost 40 years after allegedly sexually assaulting minor

A Cape Town man who allegedly sexually assaulted a minor almost 40 years ago appeared in the Mitchells Plain Magistrate’s Court on Monday.

The case against the pensioner, who was arrested in Atlantis on Friday, was postponed to Wednesday for a bail application, according to National Prosecuting Authority spokesperson Eric Ntabazalila. 

The man, 68, who cannot be identified until he pleads, in accordance with the Criminal Procedure Act related to sexual offences, allegedly sexually assaulted Emily*, 51, in 1984 and 1985.

Emily filed a case with police in November last year after her sister accused the man of sexually assaulting her as a child. She alleged the man removed her underwear and put her on his naked lap. His genitals were exposed to touch her private parts.

Emily said the man was employed by her father as a driver. He lived with them during the week and would return home on weekends.

The police arrested him on Friday, with Emily looking on from a private vehicle as she was requested to identify him without the man or his family seeing her.

She said she reported the alleged sexual assault after her sister accused the man of doing the same to her when she was five and Emily was 12. 

Emily also heard that the man transported schoolchildren and she feared that, if she didn’t report him, he could prey on other minors. 

She said the man’s wife apologised to her sister in court. She said this angered her because she didn’t feel acknowledged, despite struggling with the same trauma. 

She said the incident affected how she raised her sons because she could not trust men around them.

Before having children, she prayed that she would not have daughters because she feared they would be violated. 

Emily added:

I struggled all my life. I have never had a normal life. I once told my husband I envied him because he had a normal childhood and I never had that. I gave my children a better life as much as I could, but they never had a normal life. I was paranoid about every man around them because I knew that if my parents could trust him with me and he did that, what could happen to my children?

Emily said she wanted the man to rot in jail because she believed he was a danger to young girls and women.
